Controversy trails the declaration of a member’s seat by Kogi Speaker, Kolawole

Controversy has continued to trail the declaration of the seat of the Member representing Olamaboro state constituency Hon Eneche Ojochenemi Linus vacant by the Speaker of Kogi State of Assembly, Rt Hon Mathew kolawole on Monday

 

The Speaker said the declaration of his seat vacant followed Linus defection from the All Progressives Congress (APC) to the Peoples Democratic Party, (PDP)

 

But in a swift reaction, Eneche described the declaration of his seat vacant by the Speaker as not only reckless but an abuse of court and due process on the party of the House .

 

Speaking with journalists in Lokoja after the Kogi State House of Assembly declared his seat vacant at its plenary, , Hon. Eneche described the lawmakers action as null and void most especially that he had gone to a Lokoja High court seeking an interpretation of section 109 wanting to know if the speaker can declare his seat vacant.

According to Hon. Eneche, it was wrong for the State APC Chairman, Abdullahi Bello to have written the house to declare his seat vacant when the House was served yesterday about his seeking the interpretation of section 109.

 

According to the lawmaker, it was wrong to have deliberated on a matter when it is in court, described the action of the speaker as reckless, since he had gone to seek interpretation, seeking to restrain the speaker from declaring his seat vacant.

 

The lawmaker said having consulted with the speaker, who said he was directed to declare the seat vacant, he wondered how the house would know that he is in court if they had not been served.

Hon. Eneche said the Assembly has refused to pay him for seven months now and all efforts to confer with the Speaker proved abortive as the speaker said he was directed not to pay him

 

The lawmaker described the action of the speaker and those who directed him to declare his seat vacant when he had not transmitted a letter, wondered why the house would now declare his vacant on hear say.

 

But Speaker that their action followed the adoption of a motion moved by Majority Leader,Hon.Bello Hassan Abdullahi calling on the House to declare his seat vacant.

 

Hon.Abdullahi in his motion stated that based on his investigation and latter transmitted to the House by Kogi State Chairman of APC,Alhaji Abdullahi Bello of the lawmaker’s defection and a candidate for  Kogi state House of Assembly on the platform of PDP in 2019 General elections,he has contravened section 109-1 sub-section G of the 1999 constitution as amended.

The motion which was seconded by Hon Ahmed Mohammed resulted in heated argument from PDP members in the House because there was no evidence to prove his defection by APC and the matter is already in Court.

 

This was over ruled by the Speaker Rt. Hon Mathew kolawole The motion was put to voice vote in which 3 members present voted in favour while 2 voted against.
